Terms and Conditions

Payment

A non refundable deposit of £50/$80 per week is required to secure your booking. This is to be paid at time of booking. Confirmation of your booking will be sent to you as soon as possible. The balance of your holiday booking will then become payable 6 weeks before departure. An invoice showing the balance due will be sent 8 weeks prior to departure with payment to be received 6 weeks before departure. Bookings within 6 weeks of departure will require full payment.

We reserve the right to cancel any booking if the balance is not paid by the due date.

Security Deposit

A security deposit agreement will be sent with the final invoice. This needs to be completed and returned with the final payment. This includes credit card details and will only be used by our Management Company if there is any loss or damage in the villa, pool or surrounding area.

Use of Villa

All accommodation and community facilities are booked exclusively for the persons named on the booking form. No pets please.

Villa Access/Directions

The entrance key, villa address, directions to the villa and helpful hints will be sent to you once the final payment has been received.

Arrival/Departure

The rental commences at 4 pm on the day of arrival and ceases at 10 am on the day of departure. The property will be cleaned before your arrival and again on your departure. All rentals are inclusive of electricity, water and local taxes. Please ensure that the key is in the lock box each time you leave the villa and on your departure. Loss of the key will incur a $25 charge for replacement.

Occupancy

Florida law requires that anyone under the age of 18 years occupying the property must be accompanied by an adult. The villa must not be sub-let.

Non-smoking Policy

It is the standard policy of the owners that the property is deemed as Non-Smoking. Therefore All Guests are required not to smoke whilst in the villa. Any extra cleaning or damage, howsoever caused through Guests not abiding by this Non-Smoking Policy, will be dealt with by the deduction of such costs as required by Bridgewater Villa from their security deposit, according to the Security Bond Procedure.

Cleaning

The property will be cleaned prior to your arrival and after you have departed. Although the property will be cleaned after your departure it must still be left in an orderly state and all kitchen utensils should be washed. Guests are requested to launder as many sheets and towels as possible prior to departure. Should the property require extensive cleaning then we reserve the right to charge the Applicants credit card to pay for extra cleaning.

Pool/Jacuzzi Heating

Pool and Jacuzzi Spa heating at £110/$175 per week is an optional extra. It is however recommended between October and March.

Due to the nature of the prevailing weather systems in the sub-tropical climate of Florida, the owners cannot guarantee the water temperature in either the swimming pool or jacuzzi. The pool heater is set and locked to standard water temperatures. The heaters are set to operate at set standard hours during the day, this is to ensure that guests paying for the heating service get the optimum benefit from the heating at normal times, and that we comply with the operating requirements of the system as laid down by the manufactures. The actual water temperature will vary with the ambient temperature, time of use and prevailing weather conditions. It is strongly advised that guests cover the pool when not in use to maintain optimum temperature. The owners will NOT enter into any discussions concerning complaints regarding pool/spa temperatures, therefore guests booking pool/jacuzzi heating do so at their own risk.

Complaints

Any complaints related to the accommodations must be made to the Management Company within 24 hours of any problem arising, who will endeavour to put things right. Unless there is a valid reason, we will not be liable for any complaint that was not initially registered with the Florida representative during your stay.

The Applicant is hereby made aware that there may be other homes under construction in the area. We will not accept liability for complaints arising from construction. The owner, Management Company or their agent will not be liable for any loss or delay caused by conditions over which they have no control. The owner, Management Company or their agent will not be liable for any loss due to noise or disturbance from anywhere within the vicinity of the rental property.

Safety

The owners and their agents can not be held responsible for any personal injury or accident however caused and therefore advise all guests to have full holiday insurance. Use of the swimming pool is at the guest’s own risk. Children should be supervised at all times and should never be left unattended in and around the pool area. It is recommended that no person(s) ever swim alone. There is to be no diving into the pool or running around the deck.

Liability Limitations

Although every effort is made to ensure that the villa is in perfect condition, and as described in the literature supplied, it is a condition of acceptance of the Terms & Conditions that the Guest understands this information is as supplied at the time of writing and is subject to change without notice. It should be pointed out that as many communities still have ongoing building & construction work in progress, over which we have no control whatsoever, the owners and their representatives accept no responsibility whatsoever and no compensation or any other payment will be made to any Guest in respect of any disturbance, annoyance, inconvenience or any other problems that may be caused or created by or in response to any such building or construction work being carried out within the community. Guests specifically requiring information regarding building or construction work affecting the Villa should request this information before booking.

The owners cannot accept responsibility for third party claims, accidents, damage to, or loss of property, or for any expenses incurred for any reason, including changes caused by Force Majeure events (e.g. strikes, floods, fire, transport problems of any kind, weather conditions or any other event beyond their control), regardless of howsoever they may have occurred, nor can liability be accepted for injury as a result of the use of the pool or jacuzzi, howsoever caused. Guests are specifically advised not to allow unsupervised children to use the pool or spa. GLASS is NOT permitted in the pool or surrounding area. The owners will not accept liability for loss of main services such as electricity or water supplies.

Your Responsibilities

The party must treat the property, it’s furniture, fittings, utensils and other facilities with respect. Any loss or damage must be reported immediately to our local representative. The applicant must make good or pay for any loss, damage or breakage. We reserve the right to withhold any moneys from the security deposit or charge the Applicants credit card to pay for any loss or damage caused to the property or its contents by any member of the party.

Applicants are strongly advised to take out adequate holiday insurance to cover cancellation, accident/illness or damage. It is your responsibility to ensure that you and those for whom you are booking are in possession of valid passports and any appropriate visas. British passports must be valid for 6 months after your departure from the USA.

Cancellations

In the event that you have to cancel your booking the following charges will apply:

Deposit Non Refundable

4-6 weeks 50% of rental cost

Less than 4 weeks 100% of rental cost

All cancellations must be confirmed in writing by the person who made the booking. We are pleased to provide proof of payment for a booking for the purpose of an insurance claim.

All information contained herein was correct at the time of writing. However the owners accept no responsibility for any subsequent changes beyond their control. E.&O.E.

Your contract with us is made on the terms of this Agreement under English law and subject to the exclusive jurisdiction of the English courts.

Cancellation by The Owners

In the unlikely event that circumstances beyond our control, necessitate cancellation of the booking, we will refund any monies paid by the party leader (without interest, compensation or consequential loss of any kind).
